SPECIFIC FEATURES OF THE OBJECTIVE SIDE OF CRIMES RELATED TO ILLEGAL MIGRATION UNDER THE CRIMINAL LEGISLATION OF THE RUSSIAN FEDERATION AND THE REPUBLIC OF TAJIKISTAN

Abstract

The article provides a comparative analysis of the objective side of the elements of crimes related to the organization of illegal migration under the criminal legislation of Russia (Article 322.1 of the Criminal Code of the Russian Federation) and Tajikistan (Articles 335.1, 335.2 of the Criminal Code of the Republic of Tajikistan). Common and distinct features are identified, and forms of activity such as organizing illegal entry, stay, transit, and exit are revealed. The blanket nature of the regulations is emphasized. A conclusion is drawn regarding the formal and alternative elements of the crime. Based on Russian experience, it is proposed to supplement Tajikistan's criminal legislation with a provision on liability for organizing illegal stay.
