The article analyzes the legal consequences of failure to comply with the procedure for processing and transferring materials of operational-search activities in criminal proceedings of the Russian Federation and the Republic of Tajikistan. The relevance of the topic is determined by the need to ensure the admissibility, reliability and legal certainty of information obtained as a result of operational investigative activities when used in criminal proceedings. Their legal nature and conditions of admissibility remain the subject of academic debate, particularly in terms of the procedural legalization of information obtained covertly. The aim of the study is to identify regulatory gaps, analyze judicial practice, and formulate proposals for improving legislation and law enforcement. The methodological framework includes comparative legal, formal legal, and doctrinal methods, as well as an analysis of judicial decisions. The main approaches to assessing the admissibility of the results of operational investigative activities and the insufficient development of the problem of proceduralization of the transfer of such materials are identified. The lack of formalized procedures for the transfer and processing of documents in both countries has been established, leading to legal uncertainty and the risk of arbitrary handling of evidence. The need for regulatory codification of unified requirements and electronic document management is substantiated. The conclusions are summarized and specific measures are proposed to strengthen procedural guarantees when using materials from operational investigative activities.
