The article analyzes the basics of the application of foreign law on the basis of the doctrine, legislation and judicial practice of England, the USA and the Republic of Tajikistan, which is an urgent problem in the field of private international law. The application of foreign law on the basis of the doctrine and legislation of the named countries is considered and the distinctive features of such application are analyzed.It is indicated that the basis for the application of foreign law is the conflict of laws rule, as well as international agreements of the Republic of Tajikistan. In the event of a conflict of legal norms, the norm that has the closest connection with the civil law relationship will be applied.It is concluded that, although in England and the United States in some cases the application of foreign law is allowed, but when there is no recourse by the parties to foreign law, English courts do not have the right, as well as the obligation, to apply foreign law on the basis of the ex-officio principle.
