METHODS OF DETERMINING THE RULES RELATING TO FOREIGN LAW PARAGONS

Abstract

The article dwells on an establishment of foreign law content, problems emerging in the process of given activities carried out by court or any other body of state dealing with law application. Making references to scientific literature the author underscores that application of foreign law begins since its contents having been established. The given stage is an important one in regard to law application and it is carried into effect being proceeded from the subject`s relations with the law. The author has analyzed the issues of comprehension of foreign law as a juridical category or a factual circumstance. Home and foreign literature dealing with the issues of foreign law application has been studied in details. The spheres of powers assigned for implementation by state bodies are canvassed in so far as the establishment of foreign law contents is concerned.
